R Hotel Accommodation Terms and Conditions

(Scope of Application)
Article 1
Accommodation contracts and related agreements concluded between this hotel and guests shall be governed by these Terms and Conditions.
Matters not specified herein shall be governed by applicable laws and regulations or generally established customs.
1. Notwithstanding the preceding paragraph, if the Hotel agrees to special terms not contrary to laws, regulations, or established customs, such special terms shall take precedence.

(Application for Accommodation Contract)
Article 2
Persons wishing to apply for an accommodation contract with the Hotel shall provide the Hotel with the following information:
(1) Guest name
(2) Dates of stay and estimated arrival time
(3) Accommodation charges (in principle, based on the basic accommodation rates in Appendix 1)
(4) Other matters deemed necessary by the Hotel
1. If a guest requests to extend their stay beyond the dates specified in item (2) of the preceding paragraph during their stay, the Hotel shall treat this request as a new application for an accommodation contract made at the time the request was made.

(Establishment of Accommodation Contract, etc.)
Article 3
The lodging contract shall be established when the hotel accepts the application described in the preceding article.
However, this shall not apply if the hotel proves it did not accept the application.
1. When the lodging contract is established pursuant to the preceding paragraph, the guest shall pay the application fee set by the hotel, limited to the basic lodging fee for the lodging period (or for 3 days if the period exceeds 3 days),by the date specified by the hotel.
2. The application fee shall first be applied to the final accommodation charges payable by the guest. Should circumstances arise where the provisions of Article 6 and Article 18 apply, it shall be applied in the order of cancellation fees followed by compensation.
Any remaining balance shall be refunded at the time of payment of charges pursuant to Article 12.
3. If the application fee specified in Paragraph 2 is not paid by the date designated by the hotel pursuant to the provisions of that paragraph, the lodging contract shall lose its effect.
However, this shall apply only if the hotel has notified the guest of the designated payment date for the application fee.

(Special Agreement Exempting Payment of Application Fee)
Article 4
Notwithstanding the provisions of paragraph 2 of the preceding article, the Hotel may agree to a special provision exempting the payment of the application fee specified in that paragraph after the contract has been concluded.
1. If, upon accepting an application for an accommodation contract, the Hotel did not request payment of the application fee specified in paragraph 2 of the preceding article or did not specify a payment date for said fee,it shall be treated as having agreed to the special provision mentioned in the preceding paragraph.

(Refusal to Conclude Accommodation Contract)
Article 5
The Hotel may refuse to conclude an accommodation contract in the following cases:
(1) When the accommodation application does not comply with these Terms and Conditions.
(2) When there are no available rooms due to full occupancy.
(3) When the person seeking lodging is likely to engage in conduct contrary to laws and regulations, public order, or public morals concerning the lodging.
(4) When the person seeking lodging is clearly recognized as suffering from a contagious disease.
(5) When a burden exceeding a reasonable scope is demanded concerning the lodging.
(6) When accommodation cannot be provided due to natural disasters, facility malfunctions, or other unavoidable circumstances.

(Guest's Right to Cancel the Contract)
Article 6
A guest may cancel the lodging contract by notifying the hotel.
1. If a guest cancels all or part of the lodging contract due to reasons attributable to the guest
(except when the hotel has specified a payment date for the reservation deposit under Article 3, Paragraph 2 and requested payment, and the guest cancels the lodging contract before making such payment),the hotel shall charge a cancellation fee as listed in Appendix Table 2. However, this shall only apply if the Hotel has agreed to the special terms under Article 4, Paragraph 1, and the Hotel has notified the guest of the penalty payment procedure applicable when the guest cancels the accommodation contract at the time of agreeing to those special terms.
2. If a guest fails to arrive by 8:00 PM on the day of arrival (or two hours after the specified arrival time, if one was provided in advance) without contacting the hotel, the hotel may treat the accommodation contract as having been canceled by the guest.

(The Hotel's Right to Cancel the Contract)
Article 7
The hotel may cancel the accommodation contract in the following cases:
(1) When the person seeking lodging is deemed likely to engage in conduct contrary to laws and regulations, public order, or public morals concerning lodging, or is deemed to have engaged in such conduct.
(2) When the guest is clearly recognized as having an infectious disease.
(3) When a request is made that imposes an unreasonable burden concerning lodging.
(4) When lodging cannot be provided due to reasons attributable to force major such as natural disasters.
(5) When the guest fails to comply with prohibited items specified in the usage rules established by the hotel (limited to those necessary for fire prevention), such as smoking in bed, tampering with firefighting equipment, or other violations.
1. When the hotel cancels the lodging contract based on the provisions of the preceding paragraph, the hotel shall not charge the guest for lodging services or other fees for services not yet provided.

(Registration for Accommodation)
Article 8
On the day of accommodation, the guest shall register the following information at the hotel front desk:
(1) Guest's name, telephone number, address, and number of nights
(2) For foreign nationals: nationality, passport number, port of entry, and date of entry
(3) Departure date and scheduled departure time
(4) Other information deemed necessary by the hotel
1. When a guest intends to pay the fees specified in Article 12 using a lodging voucher, credit card, or other method equivalent to currency, they must present such items at the time of registration as described in the preceding paragraph.

(Room Usage Hours)
Article 9
Guests may use the hotel rooms from 4:00 PM until 11:00 AM the following morning.
However, for consecutive stays, guests may use the room throughout the day, excluding the arrival and departure dates.
1. Notwithstanding the preceding paragraph, the hotel may permit room usage outside the hours specified therein. An additional fee will be charged for this usage.
(1) ¥1,000 per hour (per person)
(2) If use extends beyond 1:00 PM on the check-out date, an additional night's fee shall be charged.

(Compliance with Usage Rules)
Article 10
Guests shall comply with the usage rules established and posted by the hotel within the hotel premises
(Business Hours)

Article 11
The business hours for the main facilities of this hotel are as follows. Detailed business hours for other facilities are provided in the pamphlets available on-site.
(1) Front Desk Hours
9:00 AM to 9:00 PM
1. The hours specified in the preceding paragraph may be changed when unavoidable due to necessity. In such cases, notification will be provided by appropriate means.

(Payment of Fees)
Article 12
The breakdown of lodging fees and other charges payable by guests shall be as listed in Appendix 1.
1. Payment of the lodging fees and other charges specified in the preceding paragraph shall be made at the front desk upon the guest's departure, or when requested by the hotel, using currency, hotel vouchers accepted by the hotel, credit cards, or other equivalent methods.
2. Even if the guest voluntarily chooses not to stay after the hotel has provided the guest room and made it available for use, the accommodation fee shall be charged.

(Responsibility of the Hotel)
Article 13
1. The hotel shall compensate the guest for any damages incurred due to the hotel's performance or non-performance of the lodging contract or related contracts.
However, this shall not apply if the damages were not attributable to the hotel's fault.
2. The hotel maintains lodging liability insurance to address unforeseen events such as fire.

(Handling When Contracted Rooms Cannot Be Provided)
Article 14
1. If the hotel cannot provide the contracted guest room to a guest, it shall, with the guest's consent, arrange alternative lodging at another facility under conditions as similar as possible.
2. Notwithstanding the preceding paragraph, if the hotel cannot arrange alternative lodging, it shall pay the guest compensation equivalent to the penalty fee, which shall be applied toward the amount of damages.
However, no compensation fee shall be paid if the inability to provide the room is not attributable to the Hotel.

(Storage of Guest Luggage or Personal Belongings)
Article 15
1. If a guest's luggage arrives at the Hotel prior to their check-in, the Hotel shall store it responsibly only if the Hotel has agreed to this storage in advance.
The luggage shall be handed over to the guest at the front desk upon check-in.
2. If a guest's luggage or personal belongings are left behind at the hotel after the guest has checked out, and the owner is identified, the hotel shall contact the owner and seek their instructions. However, if no instructions are given by the owner or the owner cannot be identified, the items shall be stored for 7 days including the day of discovery, after which they shall be reported to the nearest police station.
3. The hotel's liability for storing guests' luggage or personal belongings in the cases described in the preceding two paragraphs shall be governed by the provisions of the preceding article, paragraph 1 for the case described in paragraph 1, and by the provisions of the same article, paragraph 2 for the case described in the preceding paragraph.

(Guest Liability)
Article 16
If the hotel suffers damage due to the intentional act or negligence of a guest, the guest shall compensate the hotel for such damage.
